Polpo Terms of Use

1. General provisions

1.1. These Terms of Use (the "Terms") set out the rules for using the Polpo service, which comprises the polpo.by website and the application on it, including the application installed on a device (the "Service").

1.2. The Service is created and maintained by Pavel Senko, an individual, Republic of Belarus (the "Operator"). A person using the Service is hereinafter referred to as the "User".

1.3. The Terms constitute a public offer (Article 407 of the Civil Code of the Republic of Belarus) and are the same for all Users. The User accepts the Terms in full by signing in to the Service by email or with Google; this is stated on the sign-in screen next to the buttons. A User whose account was created before 05.10.2026 accepts the Terms at the next sign-in. The Operator records which version of the Terms the User accepted and when.

1.4. The processing of personal data is described in the Privacy Policy, and the records stored in the browser are described in the Cookie Policy.

2. User's age

2.1. The Service may be used from the age of 16, and from 14 to 16 with the permission of the parents (other legal representatives); persons under 14 may not use the Service. By signing in to the Service, the User confirms that they have reached the age of 16, or have reached the age of 14 and obtained the permission of their parents (other legal representatives).

2.2. Notebook photo recognition may be used only from the age of 16. If a breach of the requirements of this section is detected, the Operator deletes the account.

3. Account

3.1. The account is linked to the User's email address. The User provides an email address to which they have access.

3.2. The account is personal. The User does not disclose the PIN or codes from emails to third parties. If the PIN has become known to a third party, the User should use the "Log out everywhere" function in the profile and set a new PIN.

4. Functions of the Service

4.1. The Service is intended for learning foreign words and includes a dictionary, practice and review, ready-made word sets, examples and word selections, stories of the day, notebook photo recognition, pronunciation checking, audio, offline mode, the reef and game prizes.

4.2. The Service is provided free of charge and contains no advertising. The Operator may add, change and remove functions of the Service. Some functions have limits, for example one story of the day per day for each language.

4.3. Examples, translations, selections, stories and recognised words are created using artificial intelligence and may contain errors. Speech recognition may also make mistakes. The User should check the information they add to the dictionary.

4.4. Some functions use services of third parties, including those located in other states. The data transferred to them and the states to which they are transferred are listed in the Privacy Policy. A User who does not wish to transfer photos or voice recordings may refrain from using photo recognition and the pronunciation exercise.

5. User materials and rules of conduct

5.1. The rights to the words, sets, photos and recordings added by the User remain with the User. The Operator does not publish these materials and does not show them to other Users. For the Service to work, the User permits the Operator to store and copy them, including in backups, and to transfer them to contractors for the operation of the functions of the Service.

5.2. The User must not:

• upload personal data of third parties, including photographing other people's names and signatures in the notebook;
• upload materials that are prohibited by law or infringe the rights of third parties;
• sign in to another person's account or create an account with another person's email address;
• extract data from the Service using automated collection software, circumvent established limits, put load on the Service with automated requests, or search for vulnerabilities in order to cause harm. The User should report any vulnerability found to the Operator.

6. Violations and complaints

6.1. If a violation is detected, the Operator asks the User to remedy it and, if the User refuses, deletes the material concerned. In the event of a serious violation (illegal materials, signing in to another person's account, an attempt to hack the Service), the Operator terminates access to the account and informs the account's email address of the reason.

6.2. If the User believes that materials or actions in the Service are unlawful or infringe their rights, the User sends a complaint to polpo.site@gmail.com with the subject "Complaint". The reply is sent to the address from which the complaint was received.

7. Rights to the Service

7.1. The design, illustrations, reef creatures, ready-made word sets, website texts and program code belong to the Operator or are used by the Operator under a licence. The User may use them in the Service for learning purposes; copying and distribution outside the Service without the Operator's permission are not allowed, except in the cases provided for by law.

7.2. Some translations are taken from Wiktionary and are distributed under the Creative Commons Attribution-ShareAlike (CC BY-SA) licence.

8. Donations and game prizes

8.1. The User may voluntarily support the Service via Boosty, Patreon or by a transfer to a bank card (a "donation"). A donation is a gift under Article 543 of the Civil Code of the Republic of Belarus and does not grant any additional features: all functions of the Service are the same for all Users.

8.2. Treasures, reef creatures, scratch cards and prizes exist only in the Service and have no monetary value. They cannot be bought, sold or exchanged for money.

9. Liability

9.1. The Service is provided "as is". The Operator takes measures to ensure the uninterrupted operation of the Service but does not guarantee it, nor the fitness of the Service for a particular purpose.

9.2. As the Service is provided free of charge, the Operator is not liable for indirect losses and lost profits, for errors in texts created by artificial intelligence and in dictionaries, or for interruptions in the operation of the Service. Liability for intentional breach is not limited, nor in cases where limitation of liability is not permitted by law.

10. Account deletion and termination of access

10.1. The User may delete the account at any time in the profile using the "Delete account" function, having first downloaded their words. The data are deleted immediately, and from backups within 90 days.

10.2. If the Service is discontinued, the Operator notifies Users by email at least 30 days in advance so that they can download their words.

11. Changes to the Terms

11.1. The Operator notifies Users of material changes to the Terms by email at least 14 days in advance. The new version is accepted by the User at the next sign-in to the Service. A User who does not agree with the new version may delete the account. The current and previous versions of the Terms are published on this page.

12. Governing law and dispute resolution

12.1. The Terms are governed by the law of the Republic of Belarus. Disputes are resolved through correspondence and, if no agreement is reached, are considered by a court of the Republic of Belarus.

12.2. A User who resides in another state and uses the Service for personal purposes retains the protection afforded to them by the mandatory provisions of the law of their state of residence.

13. Language of the Terms and contact information

13.1. The Russian version of the Terms is the main version; in the event of a discrepancy between a translation and the Russian version, the Russian version prevails. Questions should be sent to polpo.site@gmail.com.
